Waste Disposal Sutton Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Disposal Sutton provides waste collection and associated services to domestic, commercial and other customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, company or organisation ordering services from Waste Disposal Sutton.

Services means any waste collection, removal, clearance, transport or related services provided by Waste Disposal Sutton.

Waste means any materials, items, rubbish, refuse or other substances collected as part of the Services, including household, commercial and bulky items, but excluding any prohibited or hazardous waste as defined in these Terms and Conditions and under applicable law.

Agreement means the contract between Waste Disposal Sutton and the Customer incorporating these Terms and Conditions and any written quotation or confirmation issued by Waste Disposal Sutton.

2. Scope of Services

Waste Disposal Sutton provides waste collection and related services within our designated service areas, including the Sutton locality and surrounding districts. The precise services, pricing and any specific conditions will be confirmed at the time of booking.

We may provide one-off waste removals, regular scheduled collections, bulky waste clearances and ad hoc collection appointments. The nature and scope of the Services will be agreed with the Customer in advance.

We reserve the right to refuse any job that, in our reasonable opinion, represents a health and safety risk, involves prohibited materials, or falls outside our operational capabilities or legal obligations.

3. Booking Process

3.1 Booking requests may be made by telephone, email or other contact method as notified by Waste Disposal Sutton from time to time. The Customer must provide accurate and complete information about the type and approximate volume of waste, the collection address, access details and any relevant restrictions.

3.2 A booking is not confirmed until Waste Disposal Sutton has accepted the request and issued a booking confirmation. This may be provided verbally, in writing or electronically, at our discretion. Once confirmed, the booking forms part of the Agreement between the parties.

3.3 Any quotation given prior to confirmation is an estimate based on the information supplied by the Customer. If, upon arrival, the volume, weight, type or location of waste materially differs from the original description, we may revise the price, alter the scope of the Services, or decline to proceed with the collection.

3.4 The Customer is responsible for ensuring that an authorised person is present at the collection address at the agreed time, unless an alternative arrangement has been agreed in advance. Where unattended collections are agreed, the Customer accepts full responsibility for ensuring that access to the waste is safe, lawful and unobstructed.

4. Service Access and Customer Obligations

4.1 The Customer must provide safe and reasonable access to the collection point, including any necessary keys, codes or permissions. Access routes must be free from obstructions and hazards, and any parking or entry restrictions must be disclosed at the time of booking.

4.2 The Customer shall ensure that waste intended for collection is clearly identified and, where required, separated according to type, such as general waste, recyclable materials or specific waste streams designated by Waste Disposal Sutton.

4.3 The Customer warrants that the waste presented for collection does not contain any prohibited, hazardous or controlled substances, including but not limited to asbestos, clinical or medical waste, corrosive chemicals, gas cylinders, explosives, oils, solvents, paint in liquid form, or electrical items requiring specialist treatment, unless expressly agreed in writing.

4.4 If our personnel reasonably believe that any waste is hazardous, unsafe or not as described, Waste Disposal Sutton may refuse to collect it, remove only part of the waste, or require additional charges to proceed in compliance with applicable regulations.

5. Pricing and Payment Terms

5.1 Prices for our Services are provided at the time of booking and may be based on factors including the type and estimated volume of waste, location, ease of access, labour required and disposal costs. All charges are quoted in pounds sterling and may be subject to VAT where applicable.

5.2 Unless agreed otherwise, payment is due on or before completion of the collection. We may accept payment by cash, card, bank transfer or other method notified at the time of booking. For business customers, we may at our discretion agree credit terms, which will be confirmed in writing.

5.3 If additional waste is presented for collection beyond the quantity initially booked, or if the job requires extra labour, time or equipment, we may apply supplementary charges. These will be explained to the Customer before any additional work is carried out where reasonably practicable.

5.4 If payment is not made when due, Waste Disposal Sutton reserves the right to charge interest on overdue sums at the statutory rate and to recover all reasonable costs incurred in pursuing payment. We may also suspend or cancel further Services until full payment has been received.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting Waste Disposal Sutton as soon as reasonably possible. Any cancellation or amendment is effective only when acknowledged by us.

6.2 If a booking is cancelled by the Customer more than 24 hours before the scheduled collection time, no cancellation fee will usually be charged. Where cancellation occurs within 24 hours of the agreed time, we reserve the right to apply a reasonable cancellation fee to cover administrative and operational costs.

6.3 If our team attends the collection address at the booked time and is unable to complete the Service due to the Customer's failure to provide access, absence of an authorised person where required, unsafe conditions, or inaccurate information, we may treat this as a late cancellation and charge a call-out or wasted journey fee.

6.4 Waste Disposal Sutton may cancel or reschedule a booking due to circumstances beyond our reasonable control, including severe weather, traffic disruption, vehicle breakdown, staff illness, safety concerns, or legal restrictions. In such cases, we will use reasonable efforts to notify the Customer and rearrange the Service at a mutually convenient time. We shall not be liable for any loss arising from such cancellation or postponement.

7. Waste Handling and Environmental Compliance

7.1 Waste Disposal Sutton operates in accordance with UK waste management legislation and relevant regulations, including duties of care relating to the transfer, transport and disposal of waste. We aim to manage waste in a responsible and environmentally considerate manner, prioritising reuse and recycling where practical.

7.2 Once waste has been collected, title and responsibility for that waste will generally pass to Waste Disposal Sutton, provided that the waste complies with the description given and does not contain prohibited materials. If we later discover that the waste contained hazardous or prohibited items that were not disclosed, we may seek recovery of any costs, fines or liabilities incurred as a result.

7.3 The Customer agrees to cooperate with any reasonable request for information or documentation relating to the nature and origin of the waste, to enable us to comply with our legal obligations and maintain proper records of collections and disposals.

7.4 We may issue waste transfer notes or similar documentation where required by law or good practice. The Customer must retain copies where legally necessary and ensure that any information they provide is accurate and complete.

8. Liability and Limitations

8.1 Waste Disposal Sutton will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that some level of noise, disturbance or minor incidental damage may occur during waste removal, especially in tight spaces or where items are large or awkward to handle.

8.2 We shall not be liable for any pre-existing damage or defects at the collection premises, including but not limited to damage to walls, floors, fixtures, fittings or access routes. The Customer is responsible for protecting surfaces and property where necessary and for informing our team of any vulnerable areas or items.

8.3 Our total liability to the Customer arising under or in connection with the Agreement, whether in contract, tort, negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable for the relevant Services, except in respect of death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited.

8.4 Waste Disposal Sutton shall not be liable for any indirect, consequential or economic losses, including loss of profit, loss of business, loss of data, or loss of opportunity, arising out of or in connection with the Services.

8.5 The Customer shall indemnify Waste Disposal Sutton against any claims, costs, damages or expenses arising from any breach by the Customer of these Terms and Conditions, including the provision of hazardous, prohibited or misdescribed waste.

9. Insurance

9.1 Waste Disposal Sutton maintains insurance cover appropriate to the nature of our Services, including public liability insurance, subject to policy terms and conditions. Details of our insurance may be made available to Customers on request.

9.2 The Customer is responsible for ensuring that they have adequate insurance cover for their own property and any third-party interests that may be affected by the provision of the Services.

10. Customer Conduct and Health and Safety

10.1 The Customer agrees to treat our personnel with respect and to refrain from abusive, aggressive or inappropriate behaviour. Waste Disposal Sutton reserves the right to withdraw Services immediately where the safety or wellbeing of our staff is at risk.

10.2 Our team may refuse to undertake any task or handle any item that they reasonably consider unsafe or beyond the agreed scope of the Services. We may also stop work if conditions at the site present an immediate health and safety risk.

10.3 The Customer shall comply with all reasonable instructions given by our staff in relation to safety, access and the handling of waste at the collection site.

11. Data Protection and Privacy

11.1 Waste Disposal Sutton may collect and process personal data relating to the Customer for the purposes of administering bookings, providing Services, handling payments, and meeting legal obligations.

11.2 We will handle personal data in accordance with applicable UK data protection laws and will take appropriate measures to safeguard the information we hold. We will not sell personal data to third parties and will only share it where necessary for the performance of the Services, compliance with law, or with the Customer's consent.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Services provided by Waste Disposal Sutton, they should contact us as soon as reasonably practicable with full details of the issue.

12.2 We will investigate complaints promptly and aim to find a fair and reasonable solution. Where appropriate, we may offer to rectify shortcomings in the Service, provide a partial refund, or take other remedial steps at our discretion.

12.3 If a dispute cannot be resolved amicably, either party may pursue their rights through the courts, subject to the governing law and jurisdiction provisions set out in these Terms and Conditions.

13. Variations to Terms

13.1 Waste Disposal Sutton may amend these Terms and Conditions from time to time, for example to reflect changes in law, industry practice or our business operations.

13.2 The version of the Terms and Conditions in force at the time of the Customer's booking will apply to that Agreement, unless a change is required by law or expressly agreed in writing by both parties.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any Agreement entered into between Waste Disposal Sutton and the Customer, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute, claim or matter arising out of or in connection with these Terms and Conditions or the Services provided.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court or competent authority, the remaining provisions shall remain in full force and effect.

15.2 No failure or delay by Waste Disposal Sutton in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy, nor shall any single or partial exercise preclude any further exercise of that or any other right or remedy.

15.3 The Agreement is between Waste Disposal Sutton and the Customer. No person other than the parties shall have any rights to enforce any of its terms.

15.4 These Terms and Conditions constitute the entire agreement between the parties in relation to the subject matter and supersede any prior understandings or representations, whether oral or written.
